Terms of services:	The terms and conditions as mentioned below constitute an agreement between New Way New Life Marketing Pvt. Ltd. (hereinafter referred to as COMPANY) and its Distributor hereinafter referred to as Distributor. A Distributor is one who duly purchases the products of the company and completes all other formalities laid down by the company. This agreement does not create an employee- employer relationship, partnership or joint venture between distributor and company. Company does not promise any kind of monitory gain in any way to Distributor. Earnings of the distributor will be solely depend on his/her own performance. Distributor shall act as an independent vendor, acting in his/her own name, at his/her own responsibility and for his/her account. The Distributor must have attained the legal age of 18 years as on date of application. The Distributor’s entraining into this agreement with his free will and consent. The company will deduct tax at source as per income tax act 1961 as well as other government taxes / duties /charges at the prevailing rate and annual processing / license / service charge. All the Distributors will use his/her best efforts to promote product and service of the company in a truthful and honest manner. Distributor will not make any false statement to take better yield. The Distributor should not use trademark, symbols, literature and slogans of the company for any other purpose other than as specified by the company REGISTRATION: The Company issues the Pin having password along with standard product called “KIT OF PRODUCT” by charging the price for the same . Before the acceptance of the scratch card the Distributor should ensure that it is well in sealed condition because once the PIN issued will be final and the company will not be responsible to exchange or refund the amount in any circumstances. Any person can submit his application through internet by using PIN mentioned on the scratch card having contractual capacity and who is resident and citizen of India. Submission of application means:- (I) Applicant has accepted and agreed to abide by all company rules, regulations, terms, conditions, marketing plan etc. prevailing at the time submission of application or any change, addition, alteration, modification etc. made in the rules, regulations, terms, conditions marketing plan etc. by the company from time to time after submission and acceptance of the application. (ii) Applicant has fully understood the company’s “Incentive Structure” (iii) Applicant has not been forced or pressurized by anybody to join the company. Password mentioned on scratch card or changed there after by the distributor will be treated as authenticated signature for the purpose of submitting any information or any other transaction. The products are now for sale to people residing in India and for Indian Nationals only The registration of distributor will become effective from the date of acceptance of agreement valid upto one year against full payment towards the purchase of products to the company. If the Distributor desires to extend his registration then he will have to submit the renewal application form before the expiry of registration. On acceptance company shall extend the registration for another 12 months period. FEES: The purchase price is towards purchase of products of company. The amount paid towards company for the purchase of products is non transferable. Courier / Octroi / Local taxes should strictly be borne by distributor only. INCENTIVES: The incentives will be paid by cheques only or account transfer. The earning / incentives are on product / services sale only. The incentives due to distributor will be transferred to his/her bank account provided that amount is more than Rs. 500/- if less, it would be carried forward for the next weekly incentives. 4% will be deducted from every payout as Business promotion fund. Annual processing charges & license fees will be deducted from the incentive . TDS will be deducted from the incentive as per applicable rate as per income tax act, 1961. 10.3% will be deducted from every payout towards repurchase. Incentive cheques will be issued on the weekly as well as monthly basis. simulation will be applied whenever applicable. PROMISES BY RECRUITING DISTRIBUTOR: No distributor is authorized to make any promises to prospect. If applicant relies on any promise, made by distributor trying to recruit him or her that is not in this agreement and or official material and that recruiting distributor fails to keep any such promise, the application only have recourse against such distributor rand not the company. The distributor should understand that under any circumstances company is not responsible for any authorized acts/ incentives committed by him. This said is responsible to indemnify the company for his unauthorized act and he will be liable for all P.V. and consequences according to law. All the distributor will use his/her efforts to promote product and service of the company in a truthful and honest manner PRODUCT / SERVICES: Delivery of product is subject to availability of products. Products will be delivered within 45 days after company receives full payment towards products. Company has sole right to change product / services / incentives/ commission/ rewards without prior notice. Though care has been taken by the company while selecting the products and marketing plan, which the company intends to market. The company in case of any problem incurred by the user shall entertain “No” claims whatsoever. Such claims would be only directed to its respective manufacturer in no events shall the company be liable for any claims or damages of any kind arising from using product. RIGHTS: The sales of products of company does not create or constitutes a joint or collaborative venture or partnership of any kind between the company and a distributor not shall be construed or creating and such joint or collaborative venture or partnership between the company and a distributor. NOMINATION: In case of death of registered distributor the benefits and distributorship will be transferred in favor of the nominee as mentioned in the application form. RIGHT OF THE COMPANY: The company reserves the sole right to change, rectify, and to amend the incentive structure, cancel and introduce rules and regulations; Policies and procedures, terms and condition from time to time and distributor shall abide by the same. Company has sole right to change product / services / incentives/ commission/ rewards without prior notice. JURISDICTION: Any dispute arising between the company and distributor will be decided according to arbitration and conciliation act 1996 and subject to ferozpur (Punjab) jurisdiction only. TERMINATION: Any distributor found to be working against the interest of the company, spoiling the name or the reputation of the company and found disturbing or diverting the distributor’s from the company or misusing customers/ potential distributors or distributors’s funds/money or contacts will be terminated without prior notice and explanation. CONTENTS: The company will not be screening the contents : 1) Provided by the user 2) Any material that is threatening, abusive, defamatory, obscene or otherwise unlawful 3) Any material that violates copy right, trademarks, patents or other property rights. MISCELLANEOUS: The signature in the application form will be taken as the distributor’s specimen signature. the company will not be responsible in case communication / Payment is not received by the distributor due to incomplete address as given by him/her.
